DISMISSED

Holding

The court held that bail could not be granted and dismissed the appeal.

Summary

The appellant, Ranjan Kumar, was charged with shooting the informant's brother under multiple provisions of the Bharatiya Nyaya Sanhita, 2023, the Arms Act and the SC/ST Act. He applied for bail before the Special Court, which was rejected. The appellant contended that he was falsely implicated and had been in custody since 15‑04‑2025. The prosecution argued that he was the principal assailant and opposed bail. The Patna High Court, after noting the appellant's alleged role as the main assailant and the seriousness of the offences, declined to grant bail and dismissed the appeal.

Issues considered

  • Whether bail can be granted to the accused under Sections 126(2), 115(2), 109, 3(5), 103(2) of the Bharatiya Nyaya Sanhita, 2023, read with Section 27 of the Arms Act and relevant provisions of the SC/ST Act, considering the nature of the alleged offence.
  • Whether the appellant's alleged status as the principal assailant and the seriousness of the crime justify denial of bail.
