Holding
The court held that bail must be granted as the allegations under the SC/ST (POA) Act were not substantiated and the appellant’s prolonged custody warranted release.
Summary
The appellant, Sajjan Yadav, was charged under several IPC provisions and the SC/ST (POA) Act for allegedly assaulting and abusing the informant and her husband by using their caste name. The appellant contended that he was falsely implicated, that the allegations were vague, and that no caste-based insult was made in public. The prosecution opposed bail, arguing the seriousness of the offences and the appellant's prior criminal record. The court examined the nature of the allegations, the lack of specific evidence of a public caste insult, and the appellant's prolonged custody since August 2025. Considering these factors, the court allowed the appeal, set aside the lower court’s denial of bail, and ordered the appellant’s release on bail with appropriate sureties.
Issues considered
- The applicability of bail provisions under the SC/ST (POA) Act in the present case
- Whether the facts alleged constitute an offence under the SC/ST (POA) Act
- Whether the appellant’s custody period and lack of specific evidence justify granting bail
