The appeal is allowed and the order rejecting anticipatory bail is set aside, directing the appellant’s release on bail.

Summary

Subodh Kumar was charged under several provisions of the Indian Penal Code and the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act for alleged assault and caste-based offences. He applied for anticipatory bail, which was rejected by the Special Judge. The appellant contended that he was falsely implicated and that the FIR did not specifically allege caste-based abuse. On appeal, the Patna High Court examined the submissions and set aside the Special Judge's order, allowing the appeal. The court directed that the appellant be released on bail upon furnishing a bail bond of Rs.5,000 with two sureties, subject to the conditions of Section 438(2) of the Cr.P.C.

Issues considered

  • Whether the appellant is entitled to anticipatory bail under Section 438 of the Cr.P.C.
  • Whether the allegations in the FIR constitute a cognizable offence under the IPC and the SC/ST Act.
  • Whether the appellant was falsely implicated in the case.
