Patna High Court

NAGESHWAR SINGHversusTHE STATE OF BIHAR

Decided
Disposal
CONSIGNED

Holding

Bail was granted to the appellant on the condition of a Rs.10,000 bond and two sureties.

Summary

The appellant, Nageshwar Singh, filed an interim application (I.A. No. 1514 of 2012) seeking bail in a criminal trial (Sessions Trial No. 217 of 2009). Earlier, the High Court had rejected his bail plea on 26 August 2011. While hearing the interim application, the Court considered the appellant's age and the observations made in the earlier bail rejection. The Court held that the appellant's age warranted a more lenient approach. Consequently, the Court ordered his release on bail upon furnishing a bail bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Sessions Judge. The interim application was disposed of with bail granted.
