Patna High Court

ARJUN SINGH @ AKHIL SINGH @ AKHIL KUMAR SINGHversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court ordered that the petitioner be released on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties.

Summary

Arjun Singh applied for regular bail in a case registered under sections 115(2), 109(1), 351(2), 352 and 3(5) of the Bhartiya Nyay Sanhita, 2023, alleging he assaulted an informant with an iron rod. The prosecution alleged that Singh and an accomplice entered the informant's house and caused serious head injuries. Singh contended that he was falsely implicated, the dispute stemmed from a trivial wheat‑crop partition issue, and the injury was merely simple. He had been in custody since 20 November 2025 and a charge‑sheet had been filed. After hearing both sides, the court granted regular bail on a bond of Rs.10,000 with two sureties, directing compliance with the Chief Judicial Magistrate.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the nature of the alleged offences under the Bhartiya Nyay Sanhita, 2023
  • Whether the alleged injury and the claim of false implication justify the grant of bail
