Patna High Court

Ajay KumarversusThe State Of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner as the recovery was not from his conscious possession and he has a clean antecedent.

Summary

Ajay Kumar was implicated in a case alleging possession of 110 litres of illicit country-made chulai liquor recovered from a motorcycle, which he does not own. The prosecution’s case relied on the statements of a co-accused and an informant, with no direct evidence of Kumar’s conscious possession. Kumar argued he is innocent, has a clean antecedent, and that the seizure witnesses are official rather than independent. The court examined the FIR, the special judge’s order, and noted that the recovery was not from Kumar’s possession. Considering the lack of direct involvement and his clean record, the court granted anticipatory bail subject to bond and surety conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the alleged recovery of illicit liquor from a vehicle not owned by him
  • Whether the petitioner’s alleged involvement, based solely on co-accused testimony, suffices for arrest

Subjects

  • anticipatory bail
  • illicit liquor
  • prohibition law
  • excise
  • clean antecedent
  • co-accused testimony
  • Section 482
