Patna High Court

Ashok Kumar Singh @ Ashok SinghversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court denied regular bail to the petitioner, holding that the seriousness of the charges and his alleged participation preclude release at this stage.

Summary

The petitioner, Ashok Kumar Singh, was arrested in connection with a violent incident on 13 April 2025 in which multiple persons were assaulted, a minor girl was abused, and a victim named Buchun later died. He is charged under several sections of the B.N.S. (including 126(2), 115(2), 118(1), 109, 324(3), 303(2), 74, 352, 351(2), 3(5) and later 103). The petitioner sought regular bail, claiming a clean antecedent and arguing that the primary assault was committed by others, not him. The State and the informant opposed bail, contending that his participation in the assault on Manish with a rod contributed to the seriousness of the offences. The court noted prior bail orders granted to co‑accused but declined to extend regular bail to the petitioner, directing that he may re‑apply after charge framing. Consequently, the bail application was rejected.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with multiple serious offences including assault leading to death
  • Whether the petitioner’s alleged participation in a single assault warrants denial of bail
