BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioners, subject to specified conditions.

Summary

The petitioners, Jimdar Kumar and Vikesh Kumar, were arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 200 litres of country-made liquor recovered from a motorcycle. They claimed innocence, stating they neither owned the motorcycle nor had any concern with the liquor, and highlighted the absence of incriminating material in their possession. The State opposed bail, citing their three prior criminal antecedents and non‑compliance with Section 103 of the BNSS, 2023. After considering the facts, custody period since 16‑12‑2025, and the petitioners' claims, the Court decided to grant bail. The bail was set at Rs.15,000 each with two sureties, subject to conditions including family surety, regular appearance, and possible cancellation on default.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act considering their custody period, prior criminal antecedents, and non‑compliance with Section 103 of the BNSS, 2023.
