Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that continued pre‑trial detention of the petitioner serves no purpose and violates Article 21, therefore bail must be granted under Sections 140(2) and 96 of the Bharatiya Nyaya Sanhita, 2023.

Summary

The petitioner, Chandan Kumar, applied for regular bail in a case registered as Barh P.S. Case No. 971 of 2024 under Sections 140(2) and 96 of the Bharatiya Nyaya Sanhita, 2023. The trial court had earlier rejected bail and only one witness had been examined, with the petitioner in custody since 11 January 2025 and having no prior criminal record. Counsel argued that the prolonged pre‑trial detention violated the petitioner’s fundamental right to life and liberty under Article 21 of the Constitution. The State opposed the bail. Considering the limited progress of the trial and the punitive nature of continued detention, the High Court inclined to grant bail, imposing a bail bond of Rs. 15,000 with two sureties and conditions regarding family surety and appearance. The order released the petitioner on bail subject to the stipulated conditions.

Issues considered

  • Whether the petitioner is entitled to regular bail under Sections 140(2) and 96 of the Bharatiya Nyaya Sanhita, 2023 given the circumstances of the case.
  • Whether continued pre‑trial detention infringes the petitioner’s right to life and liberty guaranteed under Article 21 of the Constitution of India.

of the case, period of custody of the petitioner and taking into

account the fact that continued detention of the petitioner would

serve no purpose other than punitive pretrial incarceration,

which is antithetical to the spirit of Article 21 of the

Constitution of India, this Court is inclined to grant bail to the

          petitioner.

                  7. Let the petitioner be released on bail on furnishing
