Patna High Court

Ranveer Poddar @ Ranbir PoddarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to monetary and surety conditions.

Summary

The petitioner, Ranveer Poddar, was arrested in connection with a theft of Rs. 50,000 and an ATM card on a train, alleged under Sections 305(c) and 317(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution’s case is based mainly on the confessional statement of a co‑accused, Dablu Mandal, and no material was recovered from the petitioner’s possession. The petitioner, who has eight prior criminal cases, contended that he was falsely implicated and not named in the FIR. The State opposed bail, citing the seriousness of the offences and the petitioner’s antecedents. The Court, noting the lack of direct evidence, the manner of implication, and the petitioner’s custody period, decided to grant bail subject to monetary and surety conditions. The bail order was issued with conditions regarding sureties, family involvement, and appearance at trial dates.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 305(c) and 317(5) of the Bharatiya Nyaya Sanhita, 2023 despite his criminal antecedents.
  • Whether the reliance on a co‑accused’s confessional statement, without any material recovered from the petitioner, suffices to deny bail.
  • Whether the petitioner’s non‑inclusion in the FIR affects the bail decision.
