Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail must be granted to the petitioner, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, owing to his clean antecedent and the nature of the accusations.

Summary

Chandan Kumar was named in an FIR for offences including assault, robbery and other crimes under the Bharatiya Nyaya Sanhita. He applied for anticipatory bail, claiming innocence and a clean antecedent, arguing that the allegations against him were vague and ornamental. The State opposed the bail. The court examined the nature of the accusations, the petitioner’s clean record, and the statutory provisions governing anticipatory bail. It concluded that the petitioner was entitled to anticipatory bail, subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The order directed that if arrested within eight weeks, the petitioner be released on bail upon compliance with the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the case
  • Whether the allegations in the FIR constitute sufficient ground to deny bail
