Decided
Disposal
DISPOSED

Holding

The Court held that the criminal proceedings are to be disposed of as they have become infructuous.

Summary

The petitioners sought quashing of criminal proceedings instituted against them under sections 498A, 323, 341, 504, 342, 34 of the Indian Penal Code and Section 3 of the Dowry Prohibition Act. The petition was filed before the Patna High Court, arguing that the case had become infructuous. The State, represented by an Additional Public Prosecutor, raised no objection to the prayer. The Court, after hearing counsel for both sides, held that the proceedings could be disposed of as they were no longer viable. Consequently, the petition was allowed and the criminal case was dismissed as infructuous.

Issues considered
