Holding

The petition is dismissed, and the High Court directs the lower court to dispose of the pending complaint expeditiously.

Summary

The petitioner, Jitendra Mishra, filed a petition under Section 482 of the Criminal Procedure Code seeking to quash the order dated 11-10-2017 passed by the Sessions Judge, Purnea, which dismissed his revision petition. The petition also requested that the lower court be directed to expedite the disposal of Complaint Case No. 1498 of 2000. The State of Bihar, represented by an Additional Public Prosecutor, raised no objection to the petitioner's prayer. The High Court considered the submissions of both counsel and found no merit in quashing the Sessions Judge's order. Consequently, the Court disposed of the petition, directing the concerned court to dispose of the pending complaint expeditiously. No substantive merits of the original complaint were addressed.

Issues considered

  • Whether the order of the Sessions Judge dismissing the revision petition can be quashed under Section 482 Cr.P.C.
  • Whether the High Court can direct the lower court to expedite the disposal of a pending complaint.
