Holding
The Court held that bail should be granted to the petitioners as there is no specific allegation against them and they have clean antecedents.
Summary
The petitioners, Ranjana Devi and Anita Devi, were arrested in connection with a case (PS‑258/2025) alleging offences under Sections 126(2), 115, 118(1), 109, 103 and 3(5) of the B.N.S., 2023. They contended that the FIR specifically attributes the alleged knife assault to a co‑accused, Nitish Ram, and that there is no direct allegation of assault against either petitioner, who are women with clean antecedents and have been in custody since August and September 2025 respectively. The State opposed the bail application. The Court examined the nature of the allegations, the lack of specific charge against the petitioners, and their clean record, and consequently ordered their release on bail. Each petitioner was required to furnish a bail bond of Rs 10,000 with two sureties of the same amount, to be approved by the Additional Chief Judicial Magistrate‑VI, Gopalganj. The bail order effectively disposed of the petition.
Issues considered
- Whether bail should be granted to the petitioners despite the charges under Sections 126(2), 115, 118(1), 109, 103 and 3(5) of the B.N.S., 2023.
- Whether the absence of a specific allegation of assault against the petitioners warrants bail.
