Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner, subject to specified conditions.

Summary

The petitioner, Dilip Kumar, was arrested in connection with the recovery of 70.200 litres of liquor alleged under Section 30(a) of the Bihar Prohibition and Excise Act. He claimed innocence, arguing that no incriminating material was found in his possession and that the liquor was recovered from an open area accessible to all. The petitioner had been in custody since 22‑12‑2025 and possessed three prior criminal antecedents, and the prosecution noted non‑compliance with Section 103 of the BNSS, 2023. The State opposed bail, but the court, considering the circumstances and the period of custody, decided to grant bail. Bail was ordered on a bond of Rs.15,000 with two sureties, subject to conditions including family surety, regular appearance, and possible cancellation on default.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act considering his custody period, prior antecedents, and non‑compliance with Section 103 of the BNSS, 2023.
