BAIL REJECTED

Holding

The court denied pre‑arrest bail to the petitioner.

Summary

Petitioner Ravi Shankar Sah was implicated in a FIR alleging that he, along with others, fired at an informant's house and threatened to kill the informant and his family. He faced charges under several sections of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The petitioner pleaded innocence and applied for pre‑arrest bail, claiming false implication. The State opposed bail, highlighting specific allegations of firearm use and the petitioner's two prior criminal convictions. Considering the seriousness of the accusations and the petitioner’s antecedents, the court rejected the bail application.

Issues considered

  • Whether the petitioner is entitled to pre‑arrest bail despite the nature of the offences alleged under the Bharatiya Nyaya Sanhita and the Arms Act
