Patna High Court

Sumit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Sumit Kumar, was arrested on 18 November 2025 in connection with the alleged recovery of 60 litres of liquor from an auto‑rickshaw and 20 litres from a scooty, under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. He contended that he had no prior criminal record, was unaware that the liquor was being carried, and that ownership of the scooty should not implicate him. The State opposed the bail application. The Court considered the petitioner’s clean antecedents, the circumstances of the seizure, and the principle that mere ownership of a vehicle does not automatically constitute participation in the offence. Accordingly, the Court ordered his release on bail upon furnishing a bond of Rs 5,000 with two sureties of equal amount. The bail order was directed to be complied with by the trial court handling the case (PS‑Buddha Colony Case No. 480/2025).
