Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner.

Summary

The petitioner, Sujeet Kumar, sought anticipatory bail fearing arrest in a case arising from a fight at a dance program, wherein multiple offences under the Bharatiya Nyaya Sanhita were alleged. The prosecution alleged that both groups sustained injuries, but the petitioner argued that the charges were based only on general and omnibus allegations with no specific overt act attributed to him, and he has a clean antecedent. The co‑accused Baliram Yadav had already been granted anticipatory bail in a related matter. The State opposed the bail, contending the seriousness of the offences. The Court, noting the lack of specific allegations against the petitioner and his clean record, allowed the anticipatory bail, directing that he be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite general and omnibus allegations under multiple sections of the Bharatiya Nyaya Sanhita
  • Whether the petitioner’s clean antecedent and lack of specific overt act warrant bail
