BAIL GRANTED

Holding

The court inclined to grant bail to the petitioner.

Summary

Kishan Kumar was arrested in connection with a case alleging possession of 213 litres of Nepali liquor, violating Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, stating that no incriminating material was found in his personal possession and that he had no link to the recovered liquor, a motorcycle, or a house. He had been in custody since 3 November 2025 and possessed one prior criminal antecedent, with the prosecution not complying with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the court, after considering the facts and the period of custody, decided to grant bail. The petitioner was ordered to be released on a bail bond of Rs. 15,000 with two sureties of the same amount.
