Patna High Court

Sahil KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that no prima facie case of assault exists against the petitioners and therefore granted anticipatory bail.

Summary

The petitioners, Sahil Kumar and Vishal Kumar, sought anticipatory bail after an FIR (Case No. 577 of 2025) alleged they assaulted an informant and committed criminal trespass, invoking several sections of the Bhartiya Nyay Sanhita, 2023. They contended that the case was false, filed in retaliation to an earlier SC/ST case they had lodged against the informant’s family, and asserted they had clean antecedents. The State opposed the bail. The court examined the FIR and found that no prima facie allegation of physical assault specifically against the petitioners existed. Consequently, the court ordered that the petitioners be released on anticipatory bail upon surrender within four weeks, subject to a bail bond and sureties, under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita. The order emphasized the petitioners' clean records and the lack of substantive evidence linking them to the alleged assault.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 438 of the Cr.P.C. and Section 482 of the Bhartiya Nagarik Suraksha Sanhita in view of the FIR allegations.
  • Whether the FIR establishes a prima facie case of assault against the petitioners.

                   4. Learned counsel appearing on behalf of the

petitioners submitted that prior to this occurrence a case was

lodged by petitioners’ side against the informant and family
