Patna High Court

Pappu Kumar @ Prem BabuversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The court denied regular bail as there were no fresh grounds to reconsider the earlier denial.

Summary

The petitioner, Pappu Kumar, is in judicial custody for alleged offences under Sections 25(1‑B)(a), 26 and 35 of the Arms Act, 1959. He contends that he has been falsely implicated and has been in custody since 03‑03‑2025. He previously sought regular bail, which was denied on 16‑10‑2025, and has now filed a fresh bail application. The court examined whether any new ground exists to merit bail. Finding no fresh material or change in circumstances, the court held that the earlier denial remains valid. Consequently, the petition for regular bail was rejected.

Issues considered

  • Whether the petitioner is entitled to regular bail in the present circumstances
  • Whether there are any fresh grounds justifying the grant of bail
  • Whether the nature of the offences under the Arms Act precludes bail
