Patna High Court

Veena Devi @ Gina DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Veena Devi, mother‑in‑law of a deceased man, was arrested in a murder case under Sections 103(1) and 3(5) of the B.N.S., 2023. The prosecution alleged that the petitioner was part of a conspiracy to murder the informant’s son, while the defence argued that the death was a suicide following a domestic quarrel and that no external injuries were found in the post‑mortem report. The petitioner had been in custody since 16‑12‑2025. The learned counsel for the State opposed bail, but the court considered the lack of incriminating evidence, the petitioner’s gender, and the duration of custody. Consequently, the court granted bail on a bond of Rs.10,000 with two sureties, directing compliance with the Chief Judicial Magistrate, Supaul.

Issues considered

  • Whether bail should be granted to the petitioner accused of murder under Sections 103(1) and 3(5) of the B.N.S., 2023 given the circumstances of the case
  • Whether the evidence of murder is sufficient to deny bail

2 18-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner seeks bail in a case registered for the

                                3. As per the prosecution case, son of the informant

had gone to his matrimonial house and thereafter, informant

received information that his son has been murdered. Informant

suspects that all the F.I.R. named accused persons including

                                4. Learned counsel for the petitioner submits that

petitioner is mother-in-law of the deceased and has been made

accused only on suspicion. As a matter of fact, on the alleged

date of occurrence, there was quarrel between deceased and his

wife, as a result of which, informant’s son (deceased) committed

                     bail of petitioner.

                                  6. However, considering the aforesaid facts and
