BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, subject to bond and conditions.

Summary

Pankaj Kumar was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 2,347.785 litres of liquor, part of which was recovered from a Scorpio vehicle and the co‑accused’s house. The petitioner claimed innocence, stating no liquor was found in his conscious possession, he was neither the owner nor driver of the vehicle, and that there was no material linking him to the offence. Earlier, an anticipatory bail application had been dismissed as withdrawn. The State opposed the bail, while the petitioner’s counsel highlighted his custody since 5 January 2026, five prior criminal antecedents, and non‑compliance with Section 103 of the BNSS, 2023. Considering the circumstances, the Court granted bail on a bond of Rs 15,000 with two sureties and imposed conditions regarding family surety, appearance, non‑tampering with evidence, and non‑commission of similar offences.
