The court granted regular bail to the petitioner.

Summary

Deepak Kumar was arrested in a case registered under Section 309(4) of the B.N.S. for allegedly stopping an informant, snatching his motorcycle and mobile phone, and attempting to kill him. He sought regular bail, asserting his innocence, lack of any recovered stolen property, no criminal antecedent, and noting that a similarly situated co‑accused had already been granted bail. The State opposed the bail application. The court examined the facts, the petitioner’s young age (about 19 years), the filing of the charge sheet, and the absence of any risk of absconding or evidence tampering. It ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, satisfying the learned CJM, Darbhanga. The order was delivered by Justice Sunil Dutta Mishra.
