Patna High Court

Ramesh Singh BhoktaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, finding insufficient specific evidence to justify continued detention.

Summary

The petitioner, Ramesh Singh Bhokta, was arrested in connection with a murder case (Chhakarbandha P.S. Case No. 06 of 2025) alleged to have been committed by a co-accused, Rahul Singh Bhokta, under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The prosecution alleged that the accused group lured the informant's brother with liquor and that Rahul Singh Bhokta shot him dead. The petitioner contended that he was falsely implicated, that no incriminating material was found in his possession, and that the allegations against him were vague and omnibus, noting his clean record and that other co‑accused had already been granted bail. The State opposed the bail application. Considering the lack of specific evidence against the petitioner, his long pre‑trial custody since 7 June 2025, and the precedent of bail to co‑accused, the Court inclined to grant bail, ordering release upon furnishing a bail bond of Rs.15,000 with two sureties of equal amount.
