Patna High Court

Rajesh JhaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a Rs.10,000 bond and two sureties.

Summary

Petitioner Rajesh Jha was arrested in a case alleging abduction of a minor for marriage, under Sections 137(2) and 96 of the BNS, 2023. The petitioner contended that he was falsely implicated, was not named in the FIR, and that the minor voluntarily went with the alleged abductor, denying any kidnapping or sexual assault. The victim also refused a medical examination and made no statement against the petitioner. The petitioner had been in custody for more than nine months and possessed a clean antecedent. The State opposed bail, but the Court, considering the lack of substantive evidence and the prolonged detention, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner given the allegations of abduction and the evidence (or lack thereof) presented.
  • Whether the prolonged pre‑trial custody of over nine months warrants bail.
