The High Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and compliance with the conditions under Section 482(2) of the CrPC.

Summary

Petitioner Rahul Sahani applied for anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, alleging that liquor was recovered from two motorcycles but he was not arrested on the spot and does not own the vehicles. The petitioner has three prior excise cases and claims he was implicated by a chowkidar without proper investigation. The High Court, after hearing counsel, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.15,000 with two sureties, subject to Section 482(2) of the Criminal Procedure Code. The court ordered the trial court to verify the petitioner’s criminal antecedents; if more than three prior cases are found, the bail will not be confirmed, otherwise it will be confirmed. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
