Patna High Court

Ajay Kumar @ Pannalal KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court refused to grant regular bail to the petitioner.

Summary

The petitioner, Ajay Kumar, applied for regular bail in a case registered under Section 108 of the B.N.S., alleging a clean antecedent and claiming false implication by the informant. The informant alleged that the petitioner threatened a married woman, leading to her daughter's suicide. The petitioner argued that the victim's suicide was unrelated to his actions and that the mother of the deceased could be falsely implicating him. The State opposed bail, stating the mother’s complaint is unlikely to be false and that the suicide is linked to the petitioner’s alleged conduct. After hearing both sides, the court declined to grant bail, directing that the petitioner may reapply after the charge is framed.

3 17-04-2026 1. Heard learned counsel for the petitioner and

                   learned APP for the State.

                                2. The petitioner seeks bail in Paliganj P. S. Case No.

124 of 2025 registered for the offences punishable under Section

                   108 of the B.N.S.

                                3. The learned counsel for the petitioner submits that

the petitioner is a person with clean antecedent and is in custody

since 24.11.2025. It is next submitted that informant alleges that

on 05.03.2025 at 9.30 A.M. when petitioner came to her house

and started shouting banging the door. Further, the petitioner

asked the victim to come out of the house, but she refused on

which the petitioner threatened that if she will not come with

him, he will defame her and ruined her married life and will

come again next day and again ridicule her in front of 10-15

persons. Further, on account of insult meted out, her daughter

          committed suicide by hanging.

                       4. The learned counsel for the petitioner submits that

petitioner has been falsely implicated in the instant case by the

informant. It is further submitted that petitioner and the victim

were known to each other being neighbour and the victim was

married to another person, as such, the victim out of anger

committed suicide, but then, informant for reasons best known

          implicated the petitioner.

                       5. Learned A.P.P. opposes the regular bail application

and submits that the case has been instituted by mother of the

deceased and it does not appear probable that mother would

falsely implicate the petitioner, but then, it is fairly submitted

that victim committed suicide, on which, the learned counsel

appearing on behalf of the petitioner submits that whether

victim committed suicide on account of humiliation meted out

by the petitioner or for some other reason is a matter of trial.

                       6. After hearing the learned counsel for the parties,

the Court is not inclined to release the petitioner on bail.

                       7. The prayer of the petitioner for regular bail stands

          rejected.

                                      8. However, the petitioner would be at liberty to

renew his prayer for bail after framing of charge.
