Patna High Court

Govinda Pandit @ Rohit PanditversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The bail petition was dismissed as there were no fresh grounds to merit its grant.

Summary

The petitioner, Govinda Pandit, was arrested in connection with a case registered under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. He had been in judicial custody since 6 February 2025 and earlier sought regular bail, which was denied by the High Court on 3 September 2025. The petitioner renewed his bail application, arguing that his continued detention lacked justification. The State opposed the bail, and the Court found no fresh material or change in circumstances to merit a reconsideration of bail. Consequently, the Court rejected the bail petition, directing the lower court to complete the trial within five months and allowing the petitioner to file a fresh bail application if the trial is not concluded within that period.

Issues considered

  • Whether the petitioner is entitled to bail in the absence of any fresh ground or change in circumstances since the earlier bail denial.
