Holding

Provisional anticipatory bail is granted subject to bail bonds, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Raj Kishor Ray, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 306 litres of liquor from a public area near the Bagmati river. He argued that the liquor was not in his possession, the location did not belong to him, and the complaint originated from a hostile chowkidar, raising doubts about the prosecution's case. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a Rs.20,000 bail bond with two sureties and directed verification of the petitioner’s criminal antecedent within six weeks. It further held that if more than four prior cases are found, the bail would not be confirmed; if only four are found, the bail would be confirmed. The order is subject to the provisions of Section 482(2) of the BNSS and verification by the trial court.

Issues considered
