The court granted anticipatory bail to the petitioner, subject to bail bond and surety conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Sonu Kumar, was accused of extorting Rs.2,30,000 from the informant's daughter by threatening to release compromising videos and threatening her life. The petitioner claimed innocence, stating the money was an advance for land and that no such videos existed, and highlighted his clean antecedent. The State opposed his request for anticipatory bail. The court, after considering the allegations, the petitioner’s clean record, and the possibility of surrender within six weeks, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order emphasized cooperation with the investigation and trial.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in view of the alleged blackmail and extortion charges.
  • Whether the petitioner’s clean antecedent and willingness to cooperate justify bail despite serious allegations.
