Patna High Court

Bipin YadavversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail, directing release on bail with conditions under Section 482(2) of the B.N.S.

Summary

The petitioner, Bipin Yadav, applied for anticipatory bail anticipating arrest in a case registered under Sections 126(2), 109, 352, 351(2), 303(2) and 3(5) of the B.N.S. He argued that he has a clean antecedent and that the FIR contains only a vague, omnibus allegation of assault without specific reference to him, and that the alleged injury was minor. The State opposed the bail. The Court noted the earlier anticipatory bail order in Cr. Misc. No.6239 of 2026 and, after considering the submissions, directed that the petitioner be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances alleged in the FIR
  • Whether the allegations in the FIR are specific enough to justify denial of bail
