The petitioner is entitled to regular bail subject to a bond of Rs.10,000 and the conditions imposed by the court.

Summary

The petitioner, Sumit Kumar, was arrested under Section 309(4) of the B.N.S. for allegedly participating in a robbery of Rs. 2.5 lakh from an SBI cash van, along with co‑accused. He contended that he was falsely implicated, relying on the confessional statement of another accused and the absence of any incriminating material recovered from him or his residence. The prosecution opposed bail, citing his three prior criminal antecedents, but the petitioner had already been in custody since 30‑07‑2025 and offered to cooperate with the trial. The court noted that a similarly situated co‑accused had already been granted regular bail by a coordinate bench and that there was no risk of absconding or evidence tampering. Considering these factors, the court ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties and imposed conditions of personal appearance and cooperation. The bail order is subject to cancellation if the petitioner fails to appear on two consecutive dates without sufficient cause.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 309(4) of the B.N.S. despite prior criminal antecedents and the nature of the alleged offence.
