Decided

BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Mukesh Kumar was arrested in connection with an excise case where 1,125 litres of illicit foreign liquor were seized from a truck, and he was charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act. The petitioner contended that he was falsely implicated, had no possession of the liquor, no link to the vehicle, and had no prior criminal record, also noting non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail, arguing the seriousness of the offence. The Court, after considering the lack of incriminating material against the petitioner, his clean record, and the procedural lapse, decided to grant bail. He was released on a bond of Rs. 15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
  • Whether the prosecution complied with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023.
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or influencing witnesses.
