Holding

The Court granted provisional anticipatory bail subject to verification of antecedents and specified conditions under Section 482(2) of the CrPC.

Summary

The petitioner, Kundan Kumar, sought anticipatory bail after learning of a case registered under Section 30(a) of the Bihar Excise Act alleging recovery of 180 litres of liquor from a public area near the Gandak river. He argued that the liquor was not found in his possession, the location did not belong to him, and the investigation was based on secret information. The State opposed the bail, contending the seriousness of the offence. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.5,000 with two sureties and directing the trial court to verify the petitioner’s criminal antecedents within six weeks. The order stipulated that if more than one prior case is found, the bail would not be confirmed, whereas confirmation would follow if only one antecedent case is verified.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
  • Whether provisional anticipatory bail can be confirmed after verification of antecedents.

                       5. Learned A.P.P. for the State opposes the prayer for
