Dilip Kahar @ Dilip Kumar @ Dilip Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner upon the condition of a Rs 5,000 bond and two sureties of equal amount.

Summary

The petitioner, Dilip Kahar, applied for regular bail in a criminal case registered under Sections 30(a), 41(1), 31(1) and 31(2) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 3062.52 litres of liquor from two Scorpio vehicles. The petitioner argued that he was not arrested at the spot, had no conscious possession of the liquor, was not the owner of the seized vehicles, and was implicated by a local watchman with whom he had a hostile relationship. He had been in custody since 21‑12‑2025 and assured the court that he would not abscond and would cooperate with the investigation. The State opposed the bail on the ground of the seriousness of the offences. After considering the submissions, the court directed that the petitioner be released on bail upon furnishing a bail bond of Rs 5,000 with two sureties of the same amount, subject to the satisfaction of the trial court.
