Patna High Court

Dukhi Yadav @ Dukhi Kumar YadavversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The petition for regular bail was dismissed as no fresh ground was established.

Summary

The petitioner, Dukhi Yadav, is in custody for a murder case involving the killing of the informant’s uncle, Jagarnath Yadav, and is charged under multiple sections of the Indian Penal Code. He applied for regular bail for the fifth time, having previously been denied bail in four earlier applications. The court examined whether any fresh ground existed to merit reconsideration of bail. It found no new circumstances or material change in the case that would justify granting bail. Consequently, the court rejected the petitioner's bail application, maintaining his continued detention.

Issues considered

  • Whether the petitioner is entitled to regular bail on the basis of any fresh ground.
  • Whether the repeated denial of bail in earlier applications precludes further consideration.
