Patna High Court

Nikesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that continued detention serves no purpose and infringes Article 21, and therefore granted bail to the petitioner.

Summary

Nikesh Kumar was arrested in connection with a case under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. An earlier application for regular bail was rejected, but the petitioner filed a second bail application, arguing that only two of eight prosecution witnesses had been examined and the trial was unlikely to conclude soon, amounting to a violation of his Article 21 right to liberty. The State opposed the bail. The court noted a report indicating that the trial could be completed within six months and that continued detention would be punitive and contrary to the spirit of Article 21. Consequently, the court granted bail on a cash bond of Rs. 15,000 with two sureties and imposed standard conditions regarding appearance, non‑tampering with evidence, and non‑intimidation of witnesses.

Issues considered

  • Does continued pre‑trial detention of the petitioner violate the fundamental right guaranteed under Article 21 of the Constitution of India?
  • Should bail be granted in view of the nature of the offences, the stage of the trial, and the likelihood of a speedy conclusion?

the petitioner is in custody since 07.02.2025. Learned counsel

further submits that there is no likelihood of the trial being

concluded in the near future. Learned counsel goes on to submit

that the continued incarceration of the petitioner without

conclusion of trial amounts to a gross violation of the

fundamental right guaranteed under Article 21 of the

Constitution of India, which is reiterated by Hon’ble Apex Court

          in plethora of judgments.
