The court held that provisional anticipatory bail may be granted subject to conditions and verification of the petitioner's antecedent.
Summary
The petitioner, Jitendra Kumar, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 26.25 litres of liquor and a motorcycle from Shankar Kumar's house. He argued that he had no conscious possession of the liquor, that the vehicle was merely owned by him, and that the house was a joint family property, making it uncertain whether he stored the liquor. The State opposed his request for anticipatory bail. The High Court, considering the petitioner's clean antecedent and the circumstances, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and conditions under Section 482(2) of the BNSS, pending verification of his criminal record by the trial court. The order stipulates that if any antecedent is discovered, the bail will not be confirmed; otherwise, it will be confirmed forthwith.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 30(a) of the Bihar Excise Act and Section 482(2) of the BNSS
- Whether ownership of the seized vehicle implicates the petitioner in the offence
- Whether the joint family nature of the property affects the petitioner's liability

his own vehicle for committing an occurrence and thus would
create evidence against himself and hence would get implicated,
it is further submitted that petitioner was completely unaware
that Karan would misuse the vehicle in the manner as alleged,
who was also apprehended from the spot. It is also submitted
that the house in question is a joint family property as such it

kept the liquor in the house or the liquor kept in the house was
within knowledge of the petitioner.

event if it is found that petitioner has antecedent of even one case
then it would be presumed that petitioner, for the purposes of
seeking anticipatory bail, had concealed his antecedent before this
Court, as such, the provisional anticipatory bail order shall not be
confirmed, but after verification if it is found that petitioner is a
person with clean antecedent in that event the provisional
anticipatory bail order shall be confirmed forthwith.
