The court granted provisional anticipatory bail subject to a bail bond, sureties and verification of the petitioner’s antecedent.

Summary

Arjun Kumar Chaudhary applied for anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of liquor. He asserted a clean antecedent and argued that the liquor was recovered from a location not belonging to him and that he was not caught in possession. The prosecution opposed the bail, but the court considered the lack of direct possession and the petitioner’s clean record. The High Court directed provisional anticipatory bail on a bail bond of Rs.500 with two sureties, subject to Section 482(2) of the B.N.S.S. and verification of antecedents by the trial court. It clarified that if any prior case is discovered, the bail will not be confirmed; otherwise, the provisional order will be made final. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the B.N.S.S. in a case under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether the petitioner’s clean antecedent and lack of possession justify the grant of anticipatory bail

submitted that if Chowkidar was aware of the involvement of

the petitioner in the occurrence then why he did not inform the
