Patna High Court

Arvind SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioners.

Summary

Arvind Singh and Shashi Bhushan Singh were arrested in connection with a land‑dispute case (Sugauli PS Case No. 356 of 2025) alleging assault, disrobing and other offences under the Bharatiya Nyaya Sanhita, 2023. The petitioners claimed innocence, argued that the FIR was lodged three days after the incident, that the allegations were vague and that no incriminating material was found on them. They also highlighted an ongoing title‑partition suit and noted that a co‑accused had already been granted bail. The State opposed bail, citing the seriousness of the charges and the petitioners' prior criminal antecedents. Considering the custody period, the lack of specific evidence, and parity with the co‑accused, the court granted bail on the condition of a Rs.15,000 bond and two sureties each.

Issues considered

  • Whether bail should be granted to the petitioners despite the seriousness of the offences under the Bharatiya Nyaya Sanhita, 2023
  • Whether the three‑day delay in lodging the FIR and the absence of incriminating material affect the bail decision
  • Whether the petitioners' prior criminal antecedents preclude the grant of bail
