BAIL REJECTED

Holding

Anticipatory bail was denied.

Summary

Shahnawaz Alam applied for anticipatory bail after being named in FIR No. 340 of 2025 for allegedly delivering a knife blow to the hand of Minajul Mustafa. The FIR charges him under several sections of the Bharatiya Nyaya Sanhita, including offences relating to assault, grievous hurt and other violent acts. The petitioner claimed innocence and sought bail, while the State and the informant opposed, arguing that the injury was grievous. The court examined the seriousness of the allegations and the nature of the injury. Considering the gravity of the accusations, the court refused the petition for anticipatory bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the serious nature of the offences alleged under the Bharatiya Nyaya Sanhita.
  • Whether the alleged injury constitutes grievous hurt warranting denial of bail.
