BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Bittu Kumar, was arrested in connection with a case alleging that 207 litres of country-made liquor were recovered from a vehicle, violating Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was merely a passenger, had no knowledge of the goods, was not the owner or driver, and that no incriminating material was found in his possession. The petitioner also highlighted his lack of prior criminal record and the non‑application of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the Court, after considering the circumstances and the period of custody, decided to grant bail. The order directed the petitioner to furnish a bail bond of Rs. 15,000 with two sureties of the same amount.

Issues considered
