The Court granted provisional anticipatory bail subject to verification of the petitioner’s antecedents and compliance with the stipulated bond and surety conditions.
Summary
The petitioner, Mauni Devi, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act for alleged possession of liquor recovered from a location adjacent to her house. She argued that the liquor was not in her conscious possession, the recovery site was not her property but a joint family house, and she has a clean criminal record. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties, subject to verification of the petitioner’s antecedents by the trial court. If any antecedent is found, the bail will not be confirmed; if she is found clean, the bail will be confirmed. The order was made under the inherent powers of the High Court under Section 482(2).
Issues considered
- Whether anticipatory bail can be granted to the petitioner under Section 482(2) of the CrPC in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
- Whether the alleged recovery of liquor from a property not owned by the petitioner justifies denial of bail.
