Patna High Court

Rajesh MajhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner.

Summary

The petitioner, Rajesh Majhi, was implicated in a case alleging kidnapping of a minor for marriage, with charges under Sections 137(2), 96, 352, 351(2), 3(5) of the B.N.S. and Section 8 of the POCSO Act. The victim, however, gave a statement under Section 183 of the B.N.S.S. denying any kidnapping and stating she left home of her own accord. The petitioner asserted his innocence and clean antecedents, seeking anticipatory bail. The State opposed the bail application. Considering the victim's denial, the petitioner’s clean record, and the provisions of Section 482(2) of the B.N.S.S., the Court allowed the anticipatory bail, directing bail on a bond of Rs.10,000 with two sureties, subject to conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the victim's statement denying kidnapping
  • Whether the allegations constitute a cognizable offence warranting denial of bail under Section 482(2) of the B.N.S.S.
