Bharat Kumar @ Bharat ChauhanversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to verification of antecedents and specified conditions under Section 482(2) of the CrPC.

Summary

The petitioner, Bharat Kumar, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 140 litres of liquor were recovered from an area not belonging to him and that no material was seized from his possession. He contended that the investigation was based solely on secret information without proper inquiry and highlighted his two prior excise cases. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition of a Rs 10,000 bail bond with two sureties and directed the trial court to verify his criminal antecedents. If more than two prior cases are found, the bail will not be confirmed; if exactly two are found, the bail will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail
  • Whether the circumstances of the alleged recovery justify bail without a proper investigation
