The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent and compliance with stipulated conditions.
Summary
The petitioner, Ravi Ranjan Singh, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 40 litres of liquor from a motorcycle he owned. He argued that he had a clean antecedent, was not in possession of the liquor, and was unaware that another individual, Shashi, misused his vehicle. The State opposed his request for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish bail bonds and two sureties, and that the trial court verify his criminal antecedent within six weeks. If any antecedent is discovered, the bail will not be confirmed; if he is found to have a clean record, the provisional bail will be confirmed. The order was made under Section 482(2) of the BNSS, emphasizing the need for verification before final confirmation.
Issues considered
- Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where the accused is only the owner of the vehicle used in the alleged offence.
- Whether the petitioner’s clean antecedent and lack of direct possession of the seized liquor justify the grant of anticipatory bail.
- What conditions should be imposed on the provisional anticipatory bail to safeguard the trial process.
