Patna High Court

Aditya KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner.

Summary

The petitioner, Aditya Kumar, was arrested as the driver of a vehicle from which 125.62 liters of liquor were recovered, alleged to be a violation of Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he had no knowledge of the goods, no incriminating material was found in his possession, and he had no prior criminal record. The petitioner also argued that the procedural requirements of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, were not complied with. The State opposed the bail application. Considering the lack of direct evidence against the petitioner, his clean record, and the procedural lapse, the Court granted bail on the condition of a Rs. 15,000 bond with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, warrants denial of bail.
