The court granted provisional anticipatory bail to the petitioners, subject to bail bonds and verification of their antecedents.

Summary

The petitioners, five residents of Bahilwara Bhual, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 120 litres of liquor from a public bush. They argued they have clean antecedents, were not caught in possession, and the FIR was lodged by a chowkidar without prior police notice, casting doubt on the prosecution's case. The State opposed the bail. The High Court, after hearing both sides, granted provisional anticipatory bail conditioned on the petitioners furnishing bail bonds of Rs. 500 each with two sureties, and subject to verification of their criminal antecedents by the trial court. The order stipulated that if any antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The decision rests on the court's discretion under Section 482(2) of the BNSS to prevent abuse of the process.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioners' clean antecedent and lack of possession justify provisional anticipatory bail.
  • Whether conditions imposed under Section 482(2) of the BNSS are appropriate.

                                3. Learned counsel for the petitioners submits that

petitioners were not apprehended from the spot as such nothing

was recovered from their conscious possession and even alleged

recovery is from a place which does not belong to the petitioner

and is accessible to public at large and he came to be implicated

at the instance of Chowkidar. It is further submitted that if

Chowkidar was aware of the involvement of the petitioner in the

occurrence then why he did not inform the police prior to

institution of the instant FIR which casts an aspersion on the

Court shall verify the criminal antecedent of the petitioners and

in the event if it is found that any of the petitioners have
