Patna High Court

Rohit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner.

Summary

The petitioner, Rohit Kumar, was accused of murdering a girl by drowning her, an offence punishable under Section 103(1) of the Bharatiya Nyaya Sanhita. The prosecution's case relied solely on the informant’s suspicion that the petitioner killed his daughter, with no eyewitness or material evidence linking the petitioner to the crime. The petitioner argued innocence, highlighted the lack of any incriminating material, and pointed to his clean antecedent. The State opposed the anticipatory bail application. Considering the nature of the accusation, the absence of evidence, and the petitioner’s clean record, the court granted anticipatory bail, directing that if arrested within eight weeks, the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted in a murder case under Section 103(1) of the Bharatiya Nyaya Sanhita when the prosecution’s case is based only on suspicion and lacks material evidence.
  • Whether the court may invoke Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, to grant anticipatory bail.
